This Acceptable Use Policy ("AUP") sets out the rules for using the software, web applications, mobile applications, APIs, bots and related services provided by Brook Code Technologies ("Brook Code", the "Services"). It forms part of our Terms of Service.
The AUP applies to every customer, Authorised User and anyone else who accesses the Services. Customers are responsible for making sure their Authorised Users comply with it.
1. Illegal activities
You must not use the Services to engage in, promote or facilitate any unlawful activity, including:
- Fraud, forgery, money laundering, terrorist financing or tax evasion, including recording false sales, stock or fuel quantities.
- Falsifying records required by fuel retail, weights and measures, tax or accounting laws.
- Dealing in adulterated, stolen or smuggled fuel or other goods.
- Violating economic sanctions or export control laws.
- Infringing any copyright, trademark, patent, trade secret or other intellectual property right.
- Collecting, storing or processing personal data without a lawful basis, or in breach of data protection laws.
- Uploading content that is defamatory, obscene, threatening, harassing or discriminatory.
2. Hacking and security violations
You must not:
- Access or attempt to access any account, system, data or network without authorisation.
- Probe, scan or test the vulnerability of the Services, or breach or bypass any security or authentication measure, without our prior written permission.
- Access another customer's data or attempt to break the separation between customer accounts.
- Launch or take part in denial-of-service attacks, or otherwise overload, flood or disrupt the Services.
- Intercept, monitor or tamper with traffic or data belonging to us or other customers.
- Use stolen, leaked or shared credentials, or tamper with licence checks, device limits or usage meters.
3. Reverse engineering
Except to the extent this restriction is prohibited by applicable law, you must not:
- Decompile, disassemble, reverse engineer or otherwise attempt to derive the source code, algorithms, models or data structures of the Services or our mobile apps.
- Copy, modify, translate or create derivative works of the Services.
- Access the Services to build a competing product or service, or copy their features, design or user interface.
- Remove, alter or obscure any proprietary notices, labels or marks.
4. Malware and harmful code
You must not upload, transmit or distribute viruses, worms, trojans, ransomware, spyware, logic bombs, cryptocurrency miners or any other malicious code, file or program, or use the Services to host or distribute such material.
5. Spam and unsolicited communications
Where the Services let you send messages to your customers or staff by email, SMS, WhatsApp or Telegram, you must not:
- Send unsolicited bulk or commercial messages to people who have not agreed to receive them.
- Send messages that break anti-spam and telemarketing laws, including India's telecom commercial communication regulations, the US CAN-SPAM Act and the EU ePrivacy rules.
- Break the policies of WhatsApp, Telegram or any other messaging platform.
- Use purchased, rented or harvested contact lists, or hide or falsify the sender's identity.
6. Fake accounts and impersonation
- Creating accounts with false, misleading or stolen identity or business information.
- Impersonating any person or business, or misrepresenting your affiliation with them.
- Creating multiple accounts to take repeated free trials, avoid plan limits or evade a suspension.
- Selling, renting or transferring accounts or logins without our written consent.
7. Payment fraud
- Using stolen, unauthorised or fraudulent cards, UPI handles, bank accounts or other payment methods.
- Raising chargebacks or payment disputes for valid charges after using the Services.
- Using the Services to generate false invoices, receipts or payment records, or to process fraudulent transactions.
- Manipulating prices, coupons, referral programmes or billing systems.
8. API abuse
- Exceeding documented rate limits or usage quotas, or attempting to get around them.
- Sharing, publishing or embedding API keys or tokens in public code or client-side applications.
- Using undocumented or internal endpoints, or accessing the APIs in any way other than through the interfaces we provide.
- Using the APIs to build a product that replicates the Services or to resell access to them.
- Sending malformed, excessive or automated requests intended to degrade performance.
9. Automated scraping
You must not use bots, spiders, crawlers, scrapers or other automated means to access, collect, harvest, index or copy data from the Services or our websites, except through the export tools and APIs we provide for your own Customer Data, or with our prior written consent. This includes collecting information about other customers, users or our pricing.
10. Misuse of AI features
- Submitting images, documents or text you do not have the right to use.
- Attempting to extract, reveal or manipulate the prompts, models, training data or safety controls behind our AI features.
- Using AI features to create unlawful, misleading or harmful content.
11. Security research and responsible disclosure
If you discover a security vulnerability, report it to [email protected] with enough detail for us to reproduce it. Do not access, change or delete data that is not yours, do not disrupt the Services, and give us reasonable time to fix the issue before disclosing it. We will not take legal action against good-faith research that follows these rules.
12. Monitoring and investigation
We do not routinely review Customer Data, but we may monitor use of the Services, including logs and usage patterns, to protect the Services and enforce this AUP. We may investigate suspected violations, preserve relevant records, and cooperate with law enforcement, regulators and payment networks where required or appropriate.
13. Consequences of violations
If we believe you have violated this AUP, we may take any of the following actions, depending on the severity and whether the violation is repeated. Where the risk allows, we will notify you and give you a chance to fix the problem first.
- Warning and a request to stop the activity or remove the content.
- Restriction of specific features, users, API keys or rate limits.
- Suspension of access to all or part of the Services, immediately and without prior notice where needed to prevent harm, until the issue is resolved.
- Permanent termination of your account and Subscription, without a refund of prepaid fees, as set out in our Refund and Cancellation Policy.
- Legal action, including claims for damages, injunctions, and recovery of our costs and legal fees, and reporting unlawful activity to law enforcement, regulators, payment networks or affected parties.
Our decision not to act on a violation does not waive our right to act on it or on any later violation.
14. Reporting violations
To report abuse of the Services, email [email protected] or, for security issues, [email protected]. Please include as much detail as possible, such as account names, dates, times and screenshots.
15. Changes to this policy
We may update this AUP to reflect new threats, features or legal requirements. The updated policy applies from the effective date shown at the top of this page.
